Titanoboaa Marketing ("we", "us", "our") provides website design, video production, marketing, and related digital services. These Terms & Conditions govern any services you engage us to provide. By instructing us to carry out work, you agree to these terms.
2. Enquiries and Quotes
Enquiries submitted through this website are non-binding. Any package prices, package rates, or estimates shown on this site are indicative and subject to confirmation once we understand the specifics of your project. A final scope and price will be agreed with you before work begins.
3. Engagement and Payment
Unless otherwise agreed in writing, work begins once both parties have agreed the scope and price, and any required deposit has been received. Ongoing/monthly services (such as email marketing management, call handling, or SEO) are billed on a recurring basis for as long as the service continues, and may be subject to a minimum initial term as agreed at the time of booking.
4. Cancellations and Refunds
Cancellation terms vary by service and will be confirmed with you at the point of engagement. As a general principle:
- One-off project work (e.g. website builds, video edits, funnel builds) already in progress is non-refundable for work completed, but any unstarted portion may be refunded at our discretion.
- Sourcing or matching fees (e.g. influencer sourcing) become non-refundable once a suitable match has been found and presented to you, as this reflects work already completed.
- Recurring monthly services can typically be cancelled with notice as agreed at the start of the engagement (commonly one month in writing), after any minimum term has been met.
Specific cancellation terms for your service will always be confirmed with you directly before work begins.
5. Client Responsibilities
To deliver services on time, we rely on you to provide requested materials (such as branding, copy, images, and approvals) in a timely manner, and to complete any access invitations we send during onboarding (for example, adding us as a user on your Google Business Profile or hosting account). Delays in providing these may affect delivery timescales. For your security, we will never ask you to send passwords or login details by email or through this website.
6. Intellectual Property
Unless otherwise agreed, ownership of final deliverables (such as a completed website, video files, or marketing assets) transfers to you upon full payment. We may retain the right to display completed work in our own portfolio and marketing materials, unless you ask us not to.
7. Third-Party Platforms
Some services may involve setting up or using third-party platforms (such as hosting providers, email marketing platforms, or advertising accounts). Your use of those platforms is subject to their own terms, and any costs charged directly by those platforms (such as ad spend or hosting fees) are separate from our service fees unless otherwise stated.
8. Limitation of Liability
We aim to deliver services with reasonable skill and care. To the extent permitted by law, we are not liable for indirect or consequential losses, including loss of profits or business opportunities, arising from the services provided. Nothing in these terms limits liability for matters which cannot legally be limited or excluded, such as death or personal injury caused by negligence, or fraud.
9. Marketing Results
While we work to deliver strong outcomes for every client, marketing, SEO, and advertising results depend on many factors outside our control (including market conditions, competitor activity, and platform algorithm changes). We do not guarantee specific rankings, follower counts, sales figures, or revenue outcomes.
10. Governing Law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
